Charlotte County, Fla. — More than two weeks after a deputy shot and killed a 50-year-old man in the Deep Creek area, County Sheriff Bill Prummell released body-camera footage and provided further commentary on the incident. He noted, however, that investigators still have unanswered questions.
According to the sheriff’s office, on Sept. 23, Deputy First Class Timothy Poole responded to an assault investigation involving Daniel Scott Burch. The incident began around 8:20 a.m. when the sheriff’s office received a call regarding criminal mischief at a condo complex on Saxony Circle. Poole met with the complainant who claimed property damage likely caused by Burch. Since there was no concrete evidence at that time, the deputy documented the damage and left the scene.
Later that day, at approximately 4:40 p.m., the same complainant contacted the sheriff’s office again, this time from the Deep Creek Golf Club. He reported that Burch had physically assaulted him. Video footage presented by the sheriff confirmed the complainant’s version of events, showing Burch punching him in the face. When Deputy Poole returned, the complainant said he was afraid to go home alone. Poole escorted him back to his residence adjacent to the golf course.
As they began discussing filing a report outside, Burch stepped out of his condo, confronted Poole and the victim, and appeared on the body-camera footage making a gesture and saying “come on.” Poole then told Burch to go back inside. Burch responded, “let’s do it or not do it,” and Poole asked, “are you threatening?” According to the sheriff’s office, Poole deployed his Taser after Burch made a motion toward the victim. Burch then reportedly swiped at Poole, leading Poole to call for backup, draw his firearm, and order Burch to the ground. At one point, Burch pulled out his phone and pointed it at Poole, saying, “I didn’t do anything wrong.”
At that point, the sheriff’s office states that Burch grabbed Poole’s gun and three shots were fired, hitting Burch. Poole rendered aid and Burch was airlifted to the hospital, where he died the following day.
During the press conference, Sheriff Prummell acknowledged the severity of the incident and reiterated that the investigation remains active. He stated, “Today I can’t stand before you and state in confidence that, like with the other cases, that we did everything we should have done.” He declined to take questions from reporters.
Prummell also noted that Deputy Poole has 22 years of service with the sheriff’s office, after eight years with the Department of Corrections and eight years in the U.S. Air Force. He added that Burch had a documented history of criminal behavior, citing four arrests in Florida since 1996—including a 2020 plea to resisting arrest. The sheriff’s office recorded 23 calls for service involving Burch, with 11 of those classified as disturbance calls in which he was identified as the aggressor.
